THE RECREATIONAL BOATING AND FISHING FOUNDATION SWEEPSTAKES PROMOTION

OFFICIAL CONTEST RULES and TERMS OF SERVICE

1. NO PURCHASE NECESSARY TO PLAY OR WIN.

2. ELIGIBILITY. All Recreational Boating and Fishing Foundation ("Foundation") game promotions ("Promotions") including, but not limited to, the Fishing Boat, Motor and Trailer Giveaway ("Fishing Boat Giveaway") and the Weekly Fishing Equipment Goody Bag ("Weekly Fishing Equipment Goody Bag") are open only to legal residents of the continental United States, living in the continental United States, who are at least eighteen (18) years of age. These Promotions are void in, Puerto Rico, Alaska, Hawaii and Canada. Visitors to the Foundation website, located at http://www.waterworkswonders.org ("Website"), must complete a short registration form to be eligible to play and win the game promotions. The following individuals are not eligible to participate in or claim prizes in these Promotions: employees, officers, directors, contractors and/or vendors of Foundation, their legal representatives and each of their affiliates, parents, subsidiaries, advertising, promotional, fulfillment and marketing agencies, their immediate families (and those living in their same households); officers, directors, contractors and/or vendors of federal and state natural resources, boating, fishing, and tourism agencies; boating and/or fishing industry participants, including but not limited to manufacturers, distributors, retailers, boat dealers, and/or marinas; and employees, officers, and directors of organizations with a primary mission related to recreational fishing, recreational boating and/or water quality issues.

By entering these Promotions, participants agree to release, discharge and hold harmless Foundation, their legal representatives, their affiliates, subsidiaries, retailers, agencies and their respective officers, directors, employees and agents, from any damages which may arise out of participation in these Promotions, or out of the acceptance, use, misuse or possession of prizes. It is specifically understood that winners are solely responsible for obtaining any necessary license(s) required to operate the prizes won in the Promotion. By participating, you agree to these Official Contest Rules and to the decisions of the judges, which are final and binding in all respects. The Official Contest Rules will be posted at the Website throughout the contest. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.

3. HOW TO ENTER ONLINE. You can enter Foundation's Promotions by visiting the Foundation Website and completing the online registration form, including the short survey attached thereto ("Registration"). Be sure to include your name and electronic mail ("e-mail") address. You must update this information as necessary to remain eligible to win.

4. E-MAIL INFORMATION. All website registrants will receive e-mail confirming their Registration with Foundation. Foundation also reserves the right to use e-mails to inform registrants of new benefits and features, and to advise registrants of urgent problems on our Website.

5. PRIVACY STATEMENT. For a thorough recital of Foundation's Privacy Policy please click here or return to the Foundation homepage. Foundation does not endorse, nor is Foundation responsible for the accuracy of, the Privacy Policies and/or Terms and Conditions of third party advertisers on the Foundation Website. The entities that advertise and place banner ads on the Foundation Website including, but not limited to, advertisers, are independent third parties and are not affiliated with Foundation. Foundation is not in any way liable or responsible for prizes or other product fulfillment for any contest, sale and/or other promotion on third party advertiser's websites.

6. MULTIPLE ENTRIES.

Contestants may submit one (1) Website Entry per household. Because contestants who enter the Weekly Fishing Equipment Goody Bag are automatically entered into the Fishing Boat Giveaway, only the first entry received by Foundation will be eligible to win the Fishing Boat Giveaway. Only one (1) entry per household will be considered for both the Fishing Boat Giveaway and the Weekly Fishing Equipment Goody Bag. Contestants may not enter the Fishing Boat Giveaway or the Weekly Fishing Equipment Goody Bag more than one (1) time. Foundation reserves the right to disqualify contestants that have previously entered the Weekly Fishing Equipment Goody Bag from subsequently entering future Weekly Fishing Equipment Goody Bag drawings.

A. WEBSITE ENTRIES. To submit your entry, simply complete the appropriate Registration form, which is supplied on the Foundation Website ("Website Entry"). If more than one (1) Website Entry is submitted by any registrant, whether due to software and/or hardware errors, through the use of multiple e-mail addresses, intentional or unintentional act, or for any other reason whatsoever, only the first Website Entry submitted will be accepted. All additional Website Entries beyond the permitted entries are VOID.

B. MAIL IN ENTRIES. As an alternative means of entry, contestant may substitute his/her Website Entry with a mail in entry. Mail entry to:

The mail in entry envelope or postcard may contain no more than one (1) entry, which must indicate the relevant contest period of intended play. The mail in entry should also include entrant's e-mail address, if applicable. The mail in entry must be mailed at least ten (10) days prior to the drawing date to help assure timely receipt. Your mail in entry must include your name and address so that we may mail you a confirmation of your entry and contact you if you are a winner. Any improperly submitted mail in entry (i.e. any envelope or postcard containing more than one (1) entry) will be VOID. You must produce your confirmation of mail in entry to claim any prize.

7. IDENTIFICATION OF ENTRANTS. If you are selected as the winner of a Promotion and are notified by Foundation, you must respond within thirty (30) days of notification and your identity must match the information included in the Foundation's database in order for a prize to be awarded. In the event of a dispute, the information in the Foundation's file will govern. Entries will be deemed made by the person under whose name the entry was registered, regardless of who actually submitted the entry. Be sure to use the correct log in name and your own e-mail address.

8. FOUNDATION FISHING BOAT GIVEAWAY AND WEEKLY FISHING EQUIPMENT GOODY BAG.

A. FISHING BOAT GIVEAWAY. On or about August 15th, 2002 Foundation will offer a Fishing Boat Giveaway (approximate value of $15,000). Contestants may not enter the Fishing Boat Giveaway more than one (1) time. Only one (1) entry per household will be considered for the Fishing Boat Giveaway. From the entries eligible for the Fishing Boat Giveaway drawing, a single entry will be randomly selected as the "Winner". Foundation will identify the Winner on or before August 30th, 2002. The Winner will receive the prize, pending eligibility verification. Foundation reserves the right to substitute the Fishing Boat Giveaway prize for a cash prize of commensurate value at Foundation's sole discretion.

B. WEEKLY FISHING EQUIPMENT GOODY BAG. Foundation will offer a Weekly Fishing Equipment Goody Bag (each prize has an approximate value of $100). Contestants may not enter the Weekly Fishing Equipment Goody Bag more than one (1) time for the entire duration of the Promotion. Only one (1) entry per household will be considered for the Weekly Fishing Equipment Goody Bag. Foundation reserves the right to disqualify contestants that have previously entered the Weekly Fishing Equipment Goody Bag from subsequently entering future Weekly Fishing Equipment Goody Bag drawings. From the entries submitted in a given week, a single entry will be randomly selected as the "Winner". Foundation will identify the Winner on or before 12:00 P.M (Eastern Time), on the Friday of each week. The Winner will receive the prize, pending eligibility verification. Foundation reserves the right to substitute the Weekly Fishing Equipment Goody Bag prize for a cash prize of commensurate value at Foundation's sole discretion. All entries in to the Weekly Fishing Equipment Goody Bag will also be submitted for participation in the Fishing Boat Giveaway. Only one (1) entry per household will be considered for the Fishing Boat Giveaway.

9. ODDS OF WINNING. The odds of winning any particular Promotion depend upon the number of entries received during the promotional period. Using a random selection process, the Winner for each Promotion will be fairly and impartially generated.

10. UNCLAIMED PRIZES WILL NOT BE AWARDED. Prize Winners will be required to execute and return a notarized Affidavit of Eligibility and Liability/Publicity Release within thirty (30) days following attempted notification. Non-compliance within this time period may result in disqualification. Winners will be required to provide picture proof of identification, which may include a driver's license, passport, a voting card or similar government issued identification. Return of any prize/prize notification as undeliverable may result in disqualification.

11. LIMITED TIME ONLY. Contest ends when a Promotion Winner is selected on August 15th, 2002, unless extended, whichever is sooner.

13. TAX INFORMATION. All taxes and fees on prizes won are the sole responsibility of the Winner. Foundation reserves the right to withhold taxes from each winning prize as appropriate.

14. NO SUBSTITUTION OF PRIZES. No substitution or transfer of prizes will be accommodated or permitted, other than at Foundation's sole discretion.

15. PUBLICATION. Acceptance of any prize constitutes permission for Foundation, its affiliates, subsidiaries, advertising and promotional agencies to use winner's name and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. Each winner further grants to Foundation the right to use and publish their identity and home state online and in print, or any other media, in connection with this Promotion.

16. RELEASE. By entering, each participant agrees to release and hold harmless Foundation, their legal representatives, any prize providers, advertisers and all sponsors and each of their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Promotion or any prize won. Restrictions, conditions, and limitations apply. By entering, each participant further agrees that, in the event there is any conflict or other inconsistency between the Official Contest Rules and any advertisements, promotional or marketing materials, e-mails, or announcements relevant to this Promotion, these Official Contest Rules will govern.

17. DISQUALIFICATION. Foundation reserves the right to disqualify contestants who have entered the Weekly Fishing Equipment Goody Bag during previous periods from subsequently entering in to the Weekly Fishing Equipment Goody Bag. Foundation and any affiliated companies, promotional and advertising agencies, advertisers and/or prize providers, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or Computer or telephone transmissions or technical failure, lost e-mail entries, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Promotion, as solely determined by the judges, will be disqualified. If disqualified for any of the above reasons, Foundation reserves the right to terminate player's eligibility to participate in this Promotion. In the event any portion of this Promotion is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Foundation which, in the sole opinion of Foundation, corrupts, or impairs the administration, security, fairness or proper play of the Promotion, Foundation reserves the right at its sole discretion to suspend or terminate this Promotion or any part of the Promotion, or to roll all entries into the next contest period, or any combination of the above. Foundation, and any affiliated companies, promotional and advertising agencies, advertisers and/or prize providers are not responsible for any problem with entries generated by computer hardware or software malfunction, error or failure, whatever the cause, including but not limited to, any hardware, software, microchip or other problem(s) experienced by contestants or Foundation caused by the change of calendar year to 2000, or any other generically termed Y2K problem. Foundation's sole responsibility for any irregular entry is replacement with another entry. If a potential winning entry is made by Internet or other computer entry, that potential winner may be required to provide Foundation with proof that the potential winner is the authorized account holder of the electronic mail address associated with the potential winning entry.

18. LEGAL WARNING. Any attempt by any individual, whether or not a contestant, to damage, destroy, tamper with or vandalize this Website, or otherwise interfere with the operation of this Promotion, is a violation of criminal and civil law and Foundation will diligently pursue all remedies in this regard against any offending individual or entity to the fullest extent permissible by law.
